good morning, america. breaking news -- a vacation voyage turns deadly as a tourist boats capsizes off the coast of mexico. explosive ending. attorneys in the casey anthony trial lash out in their closing arguments. >> objection. >> who made the better case? dan abrams and nancy grace break it down for us. royal mum. kate cozies up to the kids and shares her hopes for an heir. the comment that's capturing headlines on her north american tour. light them all at once. the fireworks show that never got off the ground.

and a good morning to you. happy independence day. i'm josh elliott, here today with elizabeth vargas, as robin and george are enjoying the holiday with their families. let's face it perhaps a measure of sleep. >> let's hope so. 14. and with that fireworks video, that's not if way it's supposed to work. hopefully it wililwork well as you celebrate our nation's birthday. we have lots of news. we begin with that breaking news off the coast of baja, california. a tourist boat has capsized. dozen of people have b bn thrown into the water. bianna golodryga is here with the latest. >> reporter: one american tourist was killed. all 44 people onboard, the tourism company, baja fishing, when it capsized yesterday. the boat was found 60 miles

south of san felipe, mexico. 27 onboard were tourists. the other 17 were crew members. the u.s. coast guard has launched a helicopter from san diego to help the navy conduct a search this morning. the boat started to have trouble after running into a thunderstorm and capsized in the heavy seas. >> it sank closer to shore. some were able to swim to shore. some were picked up by good samaritans that were in the area. >> reporter: now, this is in a remote area. the survivors who swam to shore had to hike to get help. one american was killed. missing.her people are currently of those eight, seven were totoists. e was a member of the boat's crew. more information as we get it. elizabeth, it's a big tourist destination. i know you've been there. >> the water is quite deep.

and attracts a lot of deep-sea fishing. >> terrifying stuff. elizabeth, now, to the latest on the explosive closing arguments in the casey anthony trial. a trial that has transfixed with some bizarre turns. judge belvin perry took the unusual step of halting proceedings as the opposing attorneys lost their collective cool. abc's yunji de nies has more, now, from orlando. yunji, good morning. >> reporter: good morning, josh. those closing arguments were riveting. full of twists and turns. fights and fireworks. at one point, the judge threatened to throw both of the attorneys off the case. and there's more to come this morning. >> there wasn't piece of duct tape placed over caylee's face. there were three. overlapping at angles. >> reporter: if you believe the prosecution, casey anthony was a party girl who wanted freedom at any cost. >> and she died because her mother decided that the life that she wanted was more important.

>> reporter: if you believe the defense, she was a victim. >> casey reacts the way she does and lies because of the environment that she was brought up in. >> reporter: with bad judgement as her only crime. >> this was an accident that owballed out of control. >> reporter: an emotional back and forth for casey anthony. in tears one moment, and showing stone-faced defiance the next, as jeff ashton talked about little caylee's death. >> we can only hope that the chloroform was used before the tape was applied. so that caylee went peacefully. >> hope? you're not supposed to hope. you're supposed to prove cases beyond and to the exclusion of every reasononle doubt. >> repepter: the judge ruled they failed to prove allegations of sexual abuse. so, they were forbidden to bring it up. >> there is no evidence that the defendant was sexually molested.

>> reporter: despite the setback, jose baez went on the attack for three hours. casting a wide net of doubt. >> the situations like fantasy searches, fantasy forensics. phantom stickers. phantom stains. all of this nonsense. the people from the fbi who inspected the shovel. there's no evidence, no dna. they went crazy trying to find more hairs, so they could say, this came from a dead body. the test for chloroform, negative. all of these other drugs, negative, negative. >> reporter: tempers flared. at one point, jose baez called out prosecutor ashton for laughing at him. >> this laughing guy right here. >> objection. >> reporter: the judge immediately stopped proceedings. threatening to throwowoth of them off the case. >> i have constantly told both sides, i personally gave each one of you the ninth

judicial circuit courtroom decorum policy. >> reporter: the prosecution will have the final word today. they'll present their rebuttal shortly. after six, long weeks this case will finally go to the jury. josh? >> yunji, in a moment, we'll look at the successes and failures of both sides. our legal team, certainly dynamic, and sometimes volcanic, are standing by. new twists in another case that's been making a lot of headlines. the case of the new york hotel maid accusing the former international monetary fund chief, dominique strauss-kahn, of sexual assault. there are new questions now about the accuser's life. and this may have derailed the case. abc's linsey davis is here with the very latest. prosecutors this morning denying that the case is dead. >> reporter: that's right. good morning. it's her credibility that's being called into question. dominique strauss-kahn has claimed all along that he's innocent. now the case has turned dramatically in his favor.

the case is so drastic, we could see a possible dismissal sooner than the next court date. just when it seemed we heard it all, more startling accusations about dominique strauss-kahn's accuser. according to "the new york post," she routinely traded sex for money. but sources close to the defendant denied that to abc news. calling it a complete fabrication. however, the d.a.'s case has been crippled. a three-page letter outlined her lies and inconsistencies about the case. >> i think you can understand why we believe from the beginning that this case was not what it appeared to be. >> reporter: just days after strauss-kahn's arrest the hotel maid reportedly called her boyfriend in immigration jail in arizona. and told him, don't worry, this guy has a lot of money. i know what i'm doing. in addition to cheating on her

taxes, there were also reports of several bank accounts in her name with large sum of money. >> she lead about the current offense and certain things surrounding it. that makes all of the lies in her past relevant. >> reporter: one part of her story has not changed. she maintains that she was sexually assaulted. >> her credibility is important. any rape victim's credibility is important. but you cannot become blind to the physical, corrrrobating evidence. >> reporter: with the d.a.'s case weakened, strauss-kahah ha been free to travel from the u.s. and in weeks, if not days, strauss-kahn could walk a free man. we're learning that a novelist is accusing strauss-kahn of attempted rape. she describes an encounter several years ago where strauss-kahn allegedly assaulted her. she is expected to file the lawsuit tomorrow in paris.

elizabeth? >> all right, linsey. what an extreme change in fortunes on that story. thanks so much. let's check back in with bianna golodryga. you have the latest developments with the exxon oil spill. >> this morning, montana's governor says exxon mobil is just guessing as the amount of damage from the spill and is downplaying the environmental affects. exxon mobil is denying the charges. here's abc's neal karlinsky. >> reporter: pelicans swimming in oily water. this is the yellowstone river in montana, a normally pristine slice of nature. now, marked by an oil spill that couldn't have come at a worst time. the river has been surging for months, pushing high water through farmland. now, it's mixed with oil, too. >> at this time, we don't know the root cause. this is a very unusual event. obviously, we have a large amount of oil entering the water very quickly.

>> reporter: in fact, exxon shut down the same line in may over concerns rising flood waters. but then, restarted it. the spill started when a 12-inch pipeline began leaking underneath the yellowstone fofoing the brief evacuation of 140 people out of fear of explosion. exxon mobil officials say a pressure change was detecteded d the line was shut off within six minutes. but the damage was already done. spilling some 42,000 gallons of oil and leaving sheens in the water reportedly seen up to 100 miles from the leak. now, cleanup crews are doing their best to soak it up and stop its spread. the yellowstone is a tributary to the missouri river. so, the concern now is to stop the oil before it flows further. for "good morning america," neal karlinsky, abc news, seattle. in other news, authorities in new mexico say the largest fire in state history burning near los alamos was caused when a tree fell across power lines.

rain over the weekend helped firefighters make enough progress to allow 12,000 evacuees finally returned home for the first time in nearly a week. the los alamos national laboratory will finally reopen on wednesday. police in san francisco have shot and killed a man at a b.a.r.t. transit station. he was reportedly drunk and carrying a knife. a police officer convicted of shooting at a b.a.r.t. station was just released from jail. protests.l sparked days of u.s. military personnel serving the country around the world are remembering the true meaning of independence day. ♪ the soldiers in the southeastern corner of afghanistan took part in a flag-raising ceremony, complete with a military band. they were sent to afghanistan as part of president obama's troop surge. they're due to return home next month. the sacrifice so many have made in the fight for freedom a stark indication this morning that more americans are unaware of the very origins of this

yesterday, some very rough weather r ving through the d.c. area. in fact, one fatality from a tree falling on a man riding his bike. you can see folks evacuating the mall as those strong storms whipped up last evening. flooding rains. five injured by lightning in the gettysburg area. the threat of a scattered shower but nothing that should be a complete washout. so, we'll look forward to that. d.c., up to 90. cloud cover in new york. 88 degrees. moving to the west. 82 in detroit. plenty of places baking in the sun this july 4th. bubble of heat up to the 90s all of the way to minneapolis.

"the sun" says that kate talked about wanting children. that's big news. and bob woodruff has the latest. >> reporter: good morning. very interesting news day today. fantastic morning here. you know that prince william is actually military helicopter pilot. he's going to be flying himself over the water here in what's called a emergency landing procedure. he's going to land it to prevent it from flipping over because of the blades. later on, a competition n tween him and his wife, kate in a dragon boat race. under the hong kong tradition. we'll find out soon who's going to win that thing later today. this is the fifth day of this remarkable tour. this has been a very, very successful time. >> reporter: prince william continued the royal couple's charm offensive in quebec city. speaking in their native tongue, french. and apologizing for his accent. the prince and his bride have been greeted with fanfare everywhere they go. they visited a shelter for troubled youths. on the streets, there were about 200 protesters. but more than a thousand fans in the french town. once again the crowd was infatuated with kate's fashions, stunning dresses by a canadian-born designer. and little girls got the chance to give her flowers. what is it like to meet the prince? >> it's a privilege. a real, real privilege. >> reporter: the father of one of them wished the duchess of cambridge well, in the couple's plans to start a family. according to "the sun" newspaper, kate who hasn't spoken publicly about wanting

children, was overheard saying, yes, i hope to. kate has made no public comments but has been very visible, interacting with adorning fans before the cameras. the next stop for us, we're heading up to the north northwest territory, a town known as yellowknife. >> great work. thank you. we're joined by abc contributor and royal editor of the sun newspaper duncan larkin also on prince edward island. i wonder, as we see canada clearly taken with the royal couple, especially kate. what's the sense you're getting from the crowd there? >> kate is totally under the microscope on this trip. everything she does is scrutinized. so far, the reception that she has has been fantastic. so far, a euphoria everywhere she goes. >> how does prince william feel

about sharing the spotlight with his wife? >> that was the way with prince charles and diana, as the marriage started to crumble. everybody wanted to see diana. and prince charles couldn't stand that. but for william, he is just loving it. william is standing back a a loving the fact that people are seeing his new bride and clearly approving of her. >> you mentioned last night it would have been princess diana's 50th birthday. how poignant was it for william to be on this trip, especially with kate? >> o ocourse, william made a speech on what would have been his mother's 50th birthday. he made no reference to his mother. i think for william, still very raw emotion there. he doesn't like talking about publicly what would have been her 50th birthday. i think william is happy to be here with kate, in what would

have been a very sad time for him. >> obviouslylythis is the rst big trip out of the gates as newlyweds. are william and kate handle it? >> well, princess diana was the master at this. what we were hoping to see is and what we may be beginning to see, iss that kate has gotot th x-factor, the star quality. she's proving that the signs are very good. we're very excited to see kate out and about, doing what she seems to do naturally. very, very encouraging so far. >> it hasn't been all open arms, however. there have been some anti-monarchy protests. how have will and kate been handling those? >> they would haveveeen well briefed before they came. i think they would take what they have had so far as success. some defensive voices. some protests. but nothing too seris.

jury is expected to begin deliberations later on today. closing arguments produced some of the biggest fireworks to date. take a listen. >> being a parent is about sacrifice. sacrificing your time and, your dreams and your life. nothing wrong with young people, drinking, dancing and having fun. that's not the life that casey has. because casey is a mom. so, she has a choice. life at the timered to a child or a life free to be 22. casey anthony decided on june 16th, that something had to be sacrificed. she chose to sacrifice her child. >> speculation upon speculation. guess upon guess.

to casey's inappropriate behavior. >> i think it was the correct ruling. if you can't present evidence you can't bring it. i think it may helped the defense. the fact that weren't able to go off on what i view a tangent actually may have helped the defense's case. >> nancy, i was struck listening to jose baez's harsh language in his closing yesterday. he repeatedly called casey a liar, how do you think it went over on the jury? >> i don't think it went over very well at all. being a liar and slut is pretty much legal in every jurisdiction in this country. it's not good to put out your client's bad points. the defense had casey anthony

barricaded by from the jury by visual aids. that was intentional. it's founded in the law. you canan argue some zanny theory to the jury. dan's spin to put a good face on it for the defense it's good for them that a major prong of their case was ruled out in closing statements is crazy. they were relying on that. her alleged sexualization by father and brother which is improbable. >> nancy, wait -- >> to explain her behavior for 31 days. >> but if you think it's improbable -- nancy, hang on one second. >> why it would help the defense to argue it? you said that it's just so improbable. >> because it's already commit td to it. that's the only excuse she got

i thought about caylee anthony and not one time in the defense closing statements did they mourn her death and i find that to be the most offensive part of their closing argument at all. other thing they did 180 on the roy kronk, meter reader that he redistributed the body. they admitted that the body there. >> i think thehe biggest proble for the defense was i think jose baez was very kocondescending. that they shouldn't be fooled or duped. it was very condescending how they're going to get snookered by the prosecution. it didn't show any level of respect for the jury. >> he repeatedly said that the prosecution hasn't given any

evidence of where caylee died or when caylee died. >> i think that in instead of focusing on as many answers they posed more questions. meaning that recognize now that the best argument they have reasonable doubt as to the cause of death. instead of saying, we know exactly how she died -- hang on one second, nancy. instead of focusing on this sort of -- you know, those long-shot-type arguments and definitive answers as to exactly how she died in the pool, they're sailing, we don't know how caylee died. >> nancy? >> bottom line, i think the state will argue you don't give a defendant a gold star because she managed to hide the body
